D\u00e9fendu par le Garde des Sceaux, Me Pac\u00f4me Yawovi ADJOUROUVI, et sous la pr\u00e9sidence du Professeur Komi Selom KLASSOU, ce texte modernise l\u2019appareil judiciaire \u00e9conomique pour offrir une meilleure s\u00e9curit\u00e9 juridique aux investisseurs et acc\u00e9l\u00e9rer le traitement des affaires.<\/span><\/p>\n<p>\u200b<strong>\u00c9volution du dispositif des juridictions commerciales<\/strong><\/p>\n<p>La nouvelle loi marque un tournant d\u00e9cisif par rapport au cadre de 2018 en rempla\u00e7ant la gestion lourde des d\u00e9marches physiques et des comparutions obligatoires par une digitalisation int\u00e9grale bas\u00e9e sur la plateforme e-Justice, les visio-audiences et la signature \u00e9lectronique des d\u00e9cisions. Pour fluidifier le traitement des dossiers, le seuil financier des proc\u00e9dures simplifi\u00e9es relatives aux \u00ab petits litiges \u00bb est rehauss\u00e9 \u00e0 5 000 000 FCFA en capital, d\u00e9sengorgeant ainsi la charge de travail des cours d&rsquo;appel. Sur le plan de la gouvernance, l&rsquo;ancien traitement g\u00e9n\u00e9rique des difficult\u00e9s financi\u00e8res c\u00e8de la place \u00e0 une chambre sp\u00e9cialis\u00e9e d\u00e9di\u00e9e \u00e0 l&rsquo;apurement du passif afin de mieux accompagner la survie des entreprises en d\u00e9tresse.
